Terms of Service

1. Second Chance Exchange is a Platform, Not a Dealer

Second Chance Exchange ("SCE," "we," "us") provides a peer-to-peer marketplace for the vaporizer community. SCE is not a party to any transaction between users. We do not buy, sell, hold, or ship any goods. We do not process or hold funds. All transactions are entirely between buyers and sellers.

SCE is not responsible for the condition of items sold, the accuracy of listings, the behavior of users, or the outcome of transactions. We provide the tools and community standards; users are responsible for exercising their own judgment.

2. Eligibility

You must be at least 18 years old to create an account or use Second Chance Exchange in any capacity. By creating an account, you represent that you meet this age requirement. You must also be legally permitted in your jurisdiction to purchase and possess the items listed on the platform.

3. Accounts

You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. You may not share accounts, transfer accounts, or create multiple accounts to circumvent a suspension or ban.

You agree to provide accurate information when registering. False information in your account may result in immediate suspension.

4. Listing Rules

By posting a listing, you represent that:

• You own the item and have the right to sell it
• The description and photos accurately represent the item
• The item is in the condition stated
• The item complies with all applicable laws where you are shipping it
• The device has been thoroughly cleaned before shipping

Listings must comply with the Listing Guidelines. SCE reserves the right to remove any listing that violates these terms without notice.

5. Transactions

SCE recommends PayPal Goods and Services for all transactions. We do not facilitate, process, escrow, or have any involvement in the financial transaction between buyer and seller.

SCE cannot resolve financial disputes between users. If a transaction goes wrong, your remedies are through your payment provider's dispute resolution process, not through SCE.

Buyers and sellers should communicate clearly, document the transaction, and use payment methods that provide buyer and seller protection.

6. Prohibited Conduct

You agree not to:

• Post listings for prohibited items (see Listing Guidelines)
• Misrepresent the condition, authenticity, or completeness of any item
• Attempt to defraud other users
• Harass, threaten, or dox other users
• Create fake accounts, buy fake reviews, or manipulate platform metrics
• Scrape, crawl, or extract data from the platform without permission
• Use SCE to promote external businesses or services without permission
• Circumvent any account suspension or ban
• Post content that is illegal, harmful, or violates the rights of others

7. Your Content

You retain ownership of content you post on SCE. By posting, you grant SCE a non-exclusive license to display, store, and distribute that content as part of operating the platform. This license ends when you delete the content or your account, except for content that has been shared by others or is needed for moderation records.

You are responsible for ensuring your content does not violate copyright, privacy rights, or any applicable law.

8. Termination

You may delete your account at any time. SCE may suspend or terminate your account for violations of these terms. Termination procedures and appeals are governed by the Moderation Policy.

9. Disclaimers and Limitation of Liability

SCE is provided "as is." We make no warranties, express or implied, about the availability, reliability, or fitness of the platform for any particular purpose.

SCE is not liable for any damages arising from your use of the platform, including but not limited to losses from transactions gone wrong, account suspension, data loss, or service interruptions. Your sole remedy for dissatisfaction with SCE is to stop using it.

These terms are governed by the laws of the jurisdiction where SCE is operated. Any disputes will be resolved through good-faith negotiation before any other process.
